In this instrument, we understand the expressions below in accordance with the following definitions:
POSTMETRIA: POSTMETRIA INTELIGÊNCIA DE MERCADO LTDA – POSTMETRIA, limited company, registered with the CNPJ under nº 21.609.198/0001-85, with headquarters in the Municipality of Porto Alegre, State of Rio Grande do Sul, at Travessa São José, nº 455, Bairro Navegantes, CEP. 90240-200.
PLATFORM: system consisting of a web PLATFORM, offered by POSTMETRIA and owned, operated and responsible by POSTMETRIA, where all USERS can view and use the services offered by POSTMETRIA.
USERS: natural or legal person, duly registered on the PLATFORM.
DATA PROCESSING: Pursuant to article 5, item 'X', of Law 13,709 of 2018, any operation carried out by the COMPANY with the USER's personal data, which is provided for in the Data Processing and Rules of the General Data Protection Law Postmetry data, such as those relating to the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation or control of information, modification, communication, transfer, dissemination or extraction. This can be requested via the email provided.
POSTMETRIA values the correct use and protection of data used in the provision of its services. In this way, POSTMETRIA follows security standards, with incident prevention training for its employees, Information Security Policy, IT Contingency Plan and Cybersecurity Risk Management Policy and adaptation to Data Processing standards Personal (LGPD). In this way, POSTMETRIA requires its partners to have the same level of security, increasing the scope of data protection.
During the USER's use of the PLATFORM, POSTMETRIA may collect and store the following information provided by USERS, under the terms of this instrument:
(i) USER'S Personal Data, such as the user's name and email;
(ii) data from the USER's internal databases, which may optionally include Personal Data from its customers;
(iii) information related to brands and products that will be monitored by POSTMETRIA in public web service providers, such as name and websites on the main social networks, and access tokens to the API of these providers.
The USER is aware that, in order to provide the Services, POSTMETRIA accesses information through APIs from companies and websites called web service providers, a category in which social networks fall, such as Google, YouTube, Twitter, Facebook, LinkedIn, among others that are current and that may appear in the future, and their use can be easily extended to support POSTMETRIA providers. An API allows POSTMETRIA to access data relating to users of these web service providers, with whom POSTMETRIA has no direct relationship, when the USER uses the Services or Software. As the Software can integrate with web service providers, it can access a large availability of data on social networks, extracted in an agile and direct way according to the functionalities of the Services, including the extraction of information about such users, brands and monitored products to which users have access, and their online posts. Therefore, to use the features derived from the API, the User agrees not only with the POSTMETRIA Privacy Policy (www.postmetria.com.br/privacidade.html), but also with the Privacy Terms of these service providers in the same way that control the use of their platforms by POSTMETRIA. The data collected from each service provider is detailed below:
(i) Facebook: name, username and profile photo of the user who authorizes the application; name and ID of pages that have some administrative access; posts, mentions and comments depending on access availability and privacy; names and profile photos of other users of these posts, mentions and comments, when available; quantitative engagement data, such as likes, reactions and comments;
(ii) Instagram: name, username and profile photo of the user who authorizes the application; name and ID of Instagram business profiles that are linked to pages managed on Facebook; posts, mentions and comments depending on access availability and privacy; names and profile photos of other users of these posts, mentions and comments, when available; quantitative engagement data, such as likes, reactions and comments;
(iii) Twitter: posts, mentions and comments related to keywords or certain user profiles, depending on access availability and privacy; names and profile photos of other users of these posts, mentions and comments, when available; quantitative engagement data, such as likes, retweets and comments;
Linkedin: name, username and profile photo of the user who authorizes the application; name and ID of pages that have some administrative access; posts, mentions and comments depending on access availability and privacy; names and profile photos of other users of these posts, mentions and comments, when available; quantitative engagement data, such as likes, reactions and comments;
(v) Youtube: videos and comments related to keywords or certain user profiles, depending on access availability and privacy; names and profile photos of other users of these videos and comments, when available; quantitative engagement data such as views, likes and comments.
POSTMETRIA and its authorized partners may also use cookies and other forms of tracking to collect and store automatically generated information, such as the characteristics of the access device, browser, access records to the PLATFORM (IP, with date and time), information accessed, screens accessed, among others, by USERS.
POSTMETRIA may also collect User Personal Data when submitting web forms and even using interactive features on the PLATFORM, including: participation in surveys, contests, promotions, sweepstakes, requesting customer support or other form of communication with the POSTMETRIA.
POSTMETRIA only provides a PLATFORM for monitoring consumer satisfaction, based on content only available on the internet, with USERS being solely responsible for the correct use of the PLATFORM's functionalities, in accordance with this instrument, and POSTMETRIA does not hold any responsibility for the use of information obtained by the USER through the PLATFORM.
The data, referred to in the collection stage of this term, from USERS, by POSTMETRIA, through the use of the PLATFORM, will be used for a variety of purposes, such as:
(i) the adequate provision of services, as described in the Platform Terms of Use (www.postmetria.com.br/termos.html);
(ii) allow the USER to access and use the PLATFORM;
(iii) obtain statistics to improve the USER’s navigation on the PLATFORM;
(iv) personalize the PLATFORM, providing resources that correspond to the USER's profile and interests;
(v) send transactional messages, including responses to USER comments, questions and requests;
(vi) provide customer service and support and send technical notices, updates, security alerts and administrative and support messages;
(vii) send promotional communications, such as information about products and services, resources, surveys, offers, newsletters, among others (the USER can opt out of receiving marketing communications by contacting atendimento@postmetria.com.br );
(viii) investigate and prevent fraudulent transactions, unauthorized access to the PLATFORM, and other illegal activities;
(ix) for other purposes for which we obtain your consent.
The USER declares to understand, accept and consent to all data collected through the PLATFORM being processed, in accordance with article 5, item 'X', of Law 13,709 of 2018, by POSTMETRIA or by third parties, these being:
(i) Google Cloud, which can be contacted via the form at support.google.com;
(ii) Google Analytics, which can be contacted via the form at support.google.com;
(iii) Intercom, which can be contacted at legal@intercom.com;
(iv) Bugsnag, which can be contacted via the form at bugsnag.com/contact.
All data provided by the USER to POSTMETRIA, through the use of the PLATFORM, will be considered confidential by POSTMETRIA, and it undertakes to make every effort to preserve the security of its systems when storing such data, meeting the safety standards established in Decree No. 8,771/2016, such as:
(i) Use of market standard methods to encrypt the collected data, in addition to other standard forms of encryption, to guarantee its inviolability;
(ii) Use of high-tech software to protect against unauthorized access to systems, which are considered controlled and security environments;
(iii) Provision of controlled access to personal data storage locations only to previously authorized and authenticated people, committed to the confidentiality of such data, including by signing a confidentiality agreement;
(iv) Application of authentication mechanisms for access to records capable of individualizing the person responsible for processing and accessing data collected as a result of the use of the PLATFORM;
(v) Anonymization of USER data when shared with third parties not partners of POSTMETRIA; It is,
(vi) Maintenance of the inventory indicating the moment, duration, identity of the employee or person responsible for access and the object file, based on connection and application access records, as determined in article 13 of Decree No. 8,771/2016 .
Os dados dos USUÁRIOS, coletados pela POSTMETRIA, por meio da utilização PLATAFORMA, poderão ser compartilhados com terceiros, nas hipóteses relacionadas abaixo:
(i) Para a proteção dos interesses da POSTMETRIA em caso de conflito, inclusive em demandas judiciais;
(ii) In the event of transactions and corporate changes involving POSTMETRIA, in which case the transfer of data will be necessary for the continuity of the services offered through the PLATFORM;
(iii) By court order or by request from administrative authorities that have legal competence to request it.
POSTMETRIA guarantees the USER, with regard to the processing of personal data, the following rights:
(i) Confirmation of the existence of processing of your personal data;
(ii) Access to your data collected by the PLATFORM, through your own login or upon request to legal@postmetria.com.br;
(iii) Correction of your data, if they are incomplete, inaccurate or out of date;
(iv) Blocking or deleting unnecessary, excessive or processed data that does not comply with applicable Brazilian legislation;
(v) The portability of personal data, for yourself or for a third party, upon express request made by the USER to POSTMETRIA, through legal@postmetria.com.br;
(vi) The deletion of personal data processed with your consent, as long as there is no legal determination to keep them registered with POSTMETRIA;
(vii) Obtaining information about public or private entities with which POSTMETRIA shared its data; It is,
(viii) Information about the possibility and consequence of not providing the USER's consent.
The USER may send an email to legal@postmetria.com.br with questions and/or requirements related to their personal data.
POSTMETRIA may delete personal data collected from USERS:
(i) When the purpose for which they were collected is achieved; or, when they are no longer necessary or relevant to achieve the purpose, in accordance with the purposes described in these Terms of Use and Privacy Policy;
(ii) When the USER revokes their consent, in cases where this is necessary, requesting exclusion to the COMPANY through legal@postmetria.com.br or,
(iii) If determined by competent authority.
