In this instrument, we understand the expressions below in accordance with the following definitions:
POSTMETRIA: POSTMETRIA INTELIGÊNCIA DE MERCADO LTDA – POSTMETRIA, limited company, registered with the CNPJ under nº 21.609.198/0001-85, with headquarters in the Municipality of Porto Alegre, State of Rio Grande do Sul, at Travessa São José, nº 455, Bairro Navegantes, CEP. 90240-200.
PLATFORM: system consisting of a web PLATFORM, offered by POSTMETRIA and owned, operated and responsible by POSTMETRIA, where all USERS can view and use the services offered by POSTMETRIA.
USERS: natural or legal person, duly registered on the PLATFORM.
DATA PROCESSING: Pursuant to article 5, item , reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation or control of information, modification, communication, transfer, dissemination or extraction.
DATA PROCESSING: Pursuant to article 5, item 'X', of Law 13,709 of 2018, any operation carried out by the COMPANY with the USER's personal data, such as those relating to collection, production, reception, classification, use , access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation or control of information, modification, communication, transfer, dissemination or extraction.
This instrument regulates the conditions of use of the PLATFORM and is a contract between USERS and the COMPANY. The use of the services offered through the PLATFORM expressly indicates that you agree with all the terms and conditions contained in this instrument and with the legal provisions applicable to the species.
YOU UNDERSTAND AND AGREE THAT THE COMPANY WILL CONSIDER THE USE OF THE PROVIDED SERVICES AS ACCEPTANCE OF THESE TERMS AND ALL OTHER LEGAL PROVISIONS PERTINENT TO THE TYPE.
BY ACCEPTING THE TERMS OF THIS INSTRUMENT, THE USER EXPRESSLY AUTHORIZES THE PROCESSING OF HIS DATA IN ORDER TO GUARANTEE THE MAINTENANCE AND GOOD PERFORMANCE OF THE PLATFORM'S FUNCTIONALITIES.
THE USER, HEREBY, EXPRESSES ITS COMPLETE CONSENT TO THE SHARING OF THE DATA COLLECTED AND PROCESSED BY THE COMPANY, UNDER THE TERMS OF THIS INSTRUMENT, WITH OTHER COMPANIES THAT ARE PART OF ITS ECONOMIC GROUP, OR ARE ITS SERVICE PROVIDERS.
If you DO NOT AGREE with the provisions set out in this instrument, DO NOT access, view, download or use in any way any page, content, information or service of the COMPANY.
These terms are available for reading, at any time, on the PLATFORM, at www.postmetria.com.br/termos.
You also declare to accept the Privacy Policy, containing the security and privacy standards adopted by POSTMETRIA in relation to the PLATFORM, available at the link www.postmetria.com.br/privacidade.
POSTMETRIA only provides a PLATFORM for monitoring consumer satisfaction, based on content only available on the internet, with USERS being solely responsible for the correct use of the PLATFORM's functionalities, in accordance with this instrument, and POSTMETRIA does not hold any responsibility for the use of information obtained by the USER through the PLATFORM.

POSTMETRIA does not have any relationship with registered USERS, and it is not possible to hold POSTMETRIA responsible for any damages caused to other USERS or third parties, due to acts originating from USERS during the use of the available functionalities of the PLATFORM.
At the time of registration, USERS will be able to use all services available on the PLATFORM, declaring, to this end, that they have read, understood and accepted all provisions contained in these Terms of Use.
The USER undertakes to use the PLATFORM's functionalities in good faith, in accordance with current legislation, morals and good customs.
The USER expressly acknowledges that the intellectual property rights over the POSTMETRIA PLATFORM are not the subject of this term and are the exclusive property of POSTMETRIA, and the transfer of usage rights to third parties outside this term is prohibited, without prior and express consent of POSTMETRIA.
The USER is solely responsible for the security of their password and the use of their account, therefore, we recommend that they do not share such information with third parties and, if this information is, for any reason, lost or hacked, the USER must immediately inform POSTMETRIA, so that the issue can be resolved.
It is only up to USERS to be responsible for any damages caused to third parties, other USERS, the PLATFORM or POSTMETRIA itself, resulting from the use of the PLATFORM's functionalities.
USERS must not use the services available on the PLATFORM for any illegal, defamatory, discriminatory, abusive, offensive, pornographic, obscene, aggressive, libelous, defamatory, deceptive, slanderous, violent, vulgar, or harassing purposes or means, threat or use of false identity, that is, any shady use that could harm POSTMETRIA, other USERS or third parties.
Under no circumstances will POSTMETRIA be held responsible for any damages incurred by USERS due to possible unavailability of the PLATFORM. The availability of any and all content made available by USERS, during the use of the functionalities available on the PLATFORM, is restricted to the availability of the PLATFORM itself, and POSTMETRIA shall not be held responsible for any damages caused to USERS due to the possible inaccessibility of content caused by the unavailability of the PLATFORM.
With the exception of purely statistical data aimed at qualifying the service, POSTMETRIA will not monitor the USER or communications made during the use of the PLATFORM.
Only capable individuals and legal entities can register on the PLATFORM.
For USERS to register on the PLATFORM, they must provide POSTMETRIA with the following data: (i) full name; (ii) email.
For regular use of the PLATFORM, the USER must register, filling in all the data requested by the PLATFORM at the time of registration.
It is the sole responsibility of USERS to provide, update and guarantee the veracity of registration data, and POSTMETRIA will not incur any type of civil or criminal liability resulting from untrue, incorrect or incomplete data provided by USERS.
POSTMETRIA reserves the right to use all valid and possible means to identify its USERS, as well as to request additional data and documents that it deems to be relevant in order to verify the data provided. In this case, the USER's use of the PLATFORM is subject to sending any requested documents.
If a registration is considered suspected of containing erroneous or untrue data, POSTMETRIA reserves the right to suspend, temporarily or definitively, without the need for prior notice, the USER responsible for the registration. In the event of suspension, the USER will not be entitled to any type of compensation or compensation for losses and damages, loss of profits or moral damages.
The USER will be able to access the information collected and the DATA PROCESSING carried out by POSTMETRIA, free of charge, through a request to legal@postmetria.com.br, or through their registration on the PLATFORM, being able to edit them or delete them at any time.

By consenting to the terms of this instrument, the USER expressly declares to be aware that the collection of their data is essential for the proper functioning of the PLATFORM, authorizing, from now on, the PROCESSING OF DATA by POSTMETRIA.
The creation of more than one registration per USER on the PLATFORM is expressly prohibited. In case of multiple registrations created by a single USER, POSTMETRIA reserves the right, at its sole discretion, without compensation and without the need for prior consent or communication, to disable all existing registrations in the name of this USER, and may not accept new registration of said USER on the PLATFORM.
The USER will access their registration on the PLATFORM through a login and password, undertaking not to inform third parties of this data, being fully responsible for the use made of them.
The USER undertakes to notify POSTMETRIA immediately, through the contact channels maintained by POSTMETRIA on the PLATFORM, regarding any unauthorized use of their account. The USER will be solely responsible for the operations carried out on his account, as access will only be possible through the use of a password known exclusively by him.

Under no circumstances will the assignment, sale, rental or other form of transfer of the USER's registration be permitted.
At its sole discretion, POSTMETRIA may exclude, disable, create limits on the use of the service, suspend, block, for an indefinite period of time, without prior notice or compensatory compensation, registrations of USERS that are considered offensive, that violate the terms of this instrument or current legislation.
POSTMETRIA reserves the right not to allow new registration of USERS who have already been cancelled, disabled, blocked, deleted or suspended from the PLATFORM. The creation of new registrations by people whose original registrations have been cancelled, blocked, disabled, excluded or suspended due to violations of POSTMETRIA policies or current legislation will not be permitted.
POSTMETRIA reserves the right to, unilaterally, without prior notice, consent or compensation, refuse any request for registration from a USER on the PLATFORM, as well as cancel, disable, block, delete or suspend the use of a previously registered accepted.
By agreeing to this instrument, the USER declares to be aware that he is solely responsible for his registration, being certain that any damage caused by the insertion of outdated, inaccurate or untrue information cannot be attributed to POSTMETRIA or PLATFORMA .
The PLATFORM offered by POSTMETRIA offers its USERS analyzes on the level of customer satisfaction regarding a given brand or product, highlighting when possible the percentage of promoters, neutrals and detractors.
These analyzes can be carried out in different periods, such as the last few months, the last year and specific time periods of interest to the USER.
So that the USER can have a better view of the analysis, it is always suggested to consult the annual analysis period.
These analyzes can be used by the USER, be it the end customer or the company itself, to make strategic decisions.
The analyzes made available by PLATFORMA go far beyond public information collected from social networks, but also from websites, e-commerce reviews, comments on applications, among other available and freely accessible sources, as well as data made available by the USER through files or API.
Among the options available to USERS to analyze a particular brand or product, PLATFORMA offers NPS analyzes of products, segments, categories, strengths and weaknesses, insights, comments, among others.

POSTMETRIA may at any time, without the need for prior notice or compensation, edit and/or delete existing features, as well as add new features to the PLATFORM.
THE PLATFORM offers the USER one of the following payment methods:
1. Bank transfer;
2. Bank slip.
Any clause or condition of this instrument that, for any reason, may be considered null or ineffective by any court or tribunal, will not affect the validity of the other provisions of these Terms, which will remain fully valid and binding, generating effects in their maximum extension.
The failure of POSTMETRIA to enforce any rights or provisions of these Terms will not constitute a waiver, and it may regularly exercise its right, within the legal deadlines.
All materials, patents, brands, registrations, domains, names, privileges, creations, images and all rights connected and related to the PLATFORM and developed by POSTMETRIA, are and will remain the sole and exclusive property of POSTMETRIA, agreeing to USERS not to perform any act or fact that, in any way, harms the rights provided for herein nor to claim any right or privilege over them.
POSTMETRIA may change this instrument at any time, simply by publishing a revised version on our website. For this reason, we strongly recommend that you always visit this section of our Website and read it periodically. However, to contribute to a good relationship, we will also send an email informing you of these changes.
This instrument constitutes the entire understanding between the USER and POSTMETRIA and is governed by Brazilian Laws, with the forum of the city of Porto Alegre – RS being elected as the only one competent to resolve issues arising from this instrument, with express waiver of any another forum, however privileged it may be.
